Triage Terms of Use

These Terms of Use are a contract between you and RoxyKovu LLC governing your use of the Triage application and its features. By downloading or using Triage, or by accepting these Terms in the app, you agree to them. If you do not agree, do not use the app.
1. The app license
Your license to use Triage is granted under Apple's standard Licensed Application End User License Agreement (the "Apple EULA"), available at https://www.apple.com/legal/macapps/stdeula/. These Terms supplement the Apple EULA. If the two conflict regarding the license to the app itself, the Apple EULA controls. This agreement is between you and RoxyKovu LLC only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app and provides no warranty for it. RoxyKovu, not Apple, is responsible for addressing any claim relating to the app, including product-liability, regulatory, and intellectual-property claims, and Apple handles refunds under its policies. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
2. Eligibility
You must be at least 13 years old and able to form a binding contract to use Triage. If you are under the age of majority where you live, you may use Triage only with the involvement of a parent or guardian. By using Triage you represent that you meet these requirements.
3. What Triage is
Triage is a personal-finance tool that helps you organize, import, categorize, and understand your own financial data on your own device. Triage is not a bank, lender, broker, money transmitter, or financial institution. It does not hold, move, or transfer money. Triage is not a debt-relief, debt-settlement, debt-management, or credit-repair service. It does not negotiate with or contact your creditors and does not promise to reduce your debt or improve your credit. It only helps you organize and understand your own financial data.
4. Not financial advice
Triage provides information, calculations, and general educational content only. It does not provide financial, investment, tax, legal, or accounting advice, and nothing in the app is a recommendation to take or avoid any financial action. Triage is not a financial advisor, broker, or fiduciary, and using it creates no advisory or fiduciary relationship. Projections and estimates are illustrative, based on data you enter, and are not guaranteed. You are solely responsible for your financial decisions. Consult a qualified professional before making financial decisions.
5. AI features
Triage offers on-device AI and an optional cloud AI mode. On-device AI keeps your data on your device. Cloud AI is off by default and runs only if you connect a third-party provider with your own API key; in that case transaction text (with account, card, routing, Social Security, and IBAN numbers redacted) is sent to that provider under its own terms, which RoxyKovu does not control. Redaction is best effort and is not guaranteed to remove every identifier. AI output may be inaccurate or incomplete, is not advice, and should be verified. You are responsible for your choice of provider and for your API key.
6. Your responsibilities
You are responsible for the accuracy of the data you enter, for safeguarding your device and any API keys you add, for choosing and complying with any third-party provider you connect, and for using Triage lawfully.
7. Free trial and purchase
Triage offers a 3-day free trial. After the trial, continued use of premium features requires a one-time purchase of $0.99 (USD; price may vary by region and is shown before purchase). The trial length, what becomes unavailable when it ends, and the price are disclosed before the trial begins. All purchases are processed by Apple through the App Store and are subject to Apple's terms. Refunds are handled by Apple under its policies.
8. Intellectual property and feedback
Triage, including its software, design, text, and the "Triage" and "RoxyKovu" names and logos, is owned by RoxyKovu LLC and protected by intellectual-property laws. These Terms give you a personal, limited, non-exclusive, non-transferable, revocable license to use the app; they transfer no ownership to you. Except as the Apple EULA or applicable law permits, you may not copy, modify, reverse engineer, resell, or create derivative works from the app. If you send us feedback or suggestions, you grant RoxyKovu a perpetual, royalty-free license to use them without any obligation to you.
9. Acceptable use, export, and sanctions
You agree to use Triage only for lawful purposes and not to misuse it or interfere with its operation. You represent that you are not located in any country subject to a U.S. Government embargo and that you are not on any U.S. Government restricted-party list. You are responsible for complying with all applicable export-control and sanctions laws.
10. Privacy
Your use is also governed by our Privacy Policy, which explains how data is stored locally on your device, when it can leave the device, and how the optional cloud AI feature works.
11. Disclaimer of warranties
To the maximum extent permitted by applicable law, Triage is provided AS IS and AS AVAILABLE, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. RoxyKovu does not warrant that the app, any AI output, or the redaction of sensitive fields will be accurate, complete, reliable, or error-free. Nothing in these Terms excludes or limits any liability or statutory right that cannot be excluded or limited under the law that applies to you. If you are a consumer in the EEA or the UK, the statutory warranties, guarantees, and remedies the law gives you apply regardless of the disclaimers above, and those disclaimers apply only to the extent permitted for consumers in your jurisdiction.
12. Limitation of liability
To the maximum extent permitted by law, RoxyKovu will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or financial loss, arising from your use of Triage. RoxyKovu's total liability for any claim will not exceed the greater of the amount you paid for the app or one U.S. dollar. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the law that applies to you, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any breach of mandatory consumer-protection rights. If you are a consumer in the EEA or the UK, these limitations apply only to the extent permitted for consumers in your jurisdiction.
13. Indemnification
You agree to indemnify and hold harmless RoxyKovu from any claims or liabilities arising from your misuse of the app, your violation of these Terms, or your use of any third-party AI provider.
14. Third-party services
Triage can connect to third-party AI providers you select. RoxyKovu is not responsible for those services, their availability, their pricing, or how they handle your data. Your use of them is governed by their terms.
15. Termination
You may stop using Triage at any time by deleting it. We may suspend or discontinue the app or features, with or without notice.
16. Dispute resolution and arbitration
Except where the mandatory consumer-protection law of your country of residence provides otherwise, these Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the arbitration provisions below. PLEASE READ THIS SECTION CAREFULLY; IT AFFECTS HOW DISPUTES ARE RESOLVED. First, informal resolution: before starting arbitration, email support@roxykovu.com a description of your dispute and give RoxyKovu 30 days to resolve it. If it is not resolved, you and RoxyKovu agree to binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. Class-action waiver: claims may be brought only in an individual capacity, not as a plaintiff or member of any class or representative action, and you and RoxyKovu waive any right to a jury trial. 30-day opt-out: you may opt out of arbitration by emailing support@roxykovu.com within 30 days of first accepting these Terms, stating your name and that you opt out; if you do, disputes will be resolved in the state or federal courts located in North Carolina. If the class-action waiver is unenforceable as to a claim, that claim proceeds in court while the rest of this section still applies. If you are a consumer who resides in the EEA, the UK, Switzerland, or any other jurisdiction whose law does not permit pre-dispute mandatory arbitration, class-action waivers, or jury-trial waivers to be enforced against consumers, this Section 16 does not apply to you to that extent; your dispute is governed by the mandatory consumer-protection laws of your country of residence, and nothing in these Terms removes your right to bring proceedings in, or to be sued only in, the courts of your country of residence as those laws provide.
17. General
These Terms, together with the Apple EULA and our Privacy Policy, are the entire agreement between you and RoxyKovu about the app and supersede any prior understanding. If any provision is held unenforceable, the rest stays in effect and the unenforceable provision is limited to the minimum extent necessary. RoxyKovu's failure to enforce a provision is not a waiver. You may not assign these Terms; RoxyKovu may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond its reasonable control.
18. Changes
We may update these Terms. For material changes, we will ask you to review and accept the updated Terms in the app. Continued use after an update means you accept the revised Terms.
